BITO's Terms And Conditions For Pilots

BITO, provided by YTORIDE TRANSPORTATION (OPC) PRIVATE LIMITED ("YTORIDE" / "Company" / "us," "we," or "our"), offers technology-based services and acts as an intermediary for facilitating on-demand transportation services by means of two-wheelers ("Bikes"), three-wheelers ("Autos"), and four-wheelers ("Cars") (collectively, "Vehicles") ("Transportation Services"). These Transportation Services are offered through our mobile application "BITO" (collectively, "Platform").

The Transportation Services are provided / offered by third-party vehicle operators, service providers, or Pilots who wish to offer such Services through the Platform ("Pilots" / "you").

On the basis of the representations and warranties provided by the Pilots, the Company has agreed to list the Vehicles on the Platform and to enable the Pilots to provide the Services through the Platform in accordance with the terms and conditions as hereinafter provided and any other policy or agreement or document made applicable / executed by you for the purpose of the provision of Services (collectively, "T&Cs"). These T&Cs will govern the relationship between you and the Company in the course of the provision of Services. By signing up or registering on the Platform and offering to provide one or more of the Services, you acknowledge that you have read and understood these T&Cs and agree to be bound by these T&Cs, without any limitation or qualification. If you do not agree with these T&Cs, please do not sign up or register on the Platform or offer any Services.

Use of and access to the Platform is offered to you upon the unconditional acceptance of all the terms, conditions, and notices contained in these T&Cs and Privacy Policy (which is incorporated herein by reference), along with any amendments made by the Company at its sole discretion and posted on the Platform from time to time.

These T&Cs expressly supersede prior agreements or arrangements with you.

I. GENERAL COVENANTS

In relation to your access to the BITO platform and the provision of services as a Pilot, you are required to adhere to the following:

Eligibility:

To register an account on the BITO platform and offer services, you must confirm that you are at least 18 years of age.

Legal Compliance:

You must not be subject to any legal, regulatory, judicial, quasi-judicial, or other authority restrictions that prohibit your access to the BITO platform or your ability to provide services, including participating in transactions facilitated by the platform.

Compliance with Terms:

You agree to provide services exclusively as permitted by and in accordance with the BITO platform's Terms and Conditions (T&Cs) and in compliance with applicable laws.

Authorization for Information:

By utilizing the BITO platform and offering services, you grant BITO, whether directly or indirectly through third parties, the authority to collect information about you and perform any necessary identity verification procedures, including police verification and background checks, as outlined in our Privacy Policy. Please review our Privacy Policy to understand how we gather, process, and share your information, encompassing personal and sensitive personal data or information ("Information").

Accuracy of Information:

When providing any Information to BITO, you must ensure that it is true, accurate, current, and complete. You acknowledge that the responsibility for providing accurate Information, such as contact details and bank account information, in connection with the services lies solely with you. It is your responsibility to ensure that no errors or inaccuracies are present in the Information you furnish. BITO is not responsible for verifying the accuracy of the Information provided by you.

These guidelines set forth valid and legally binding obligations, which you are obliged to adhere to and which can be enforced against you in accordance with our company's policies.

II. REGISTRATION ON AND OPERATION OF THE BITO PLATFORM

To offer your services on the BITO platform, you must meet specific eligibility criteria and provide requested documents in compliance with applicable laws and BITO's internal policies. You hereby represent, warrant, and commit to BITO that:

Driving Experience:

You possess a minimum of 2 years of driving experience.

Criminal Record:

No ongoing legal proceedings are pending against you, and you have not been convicted of:

Driving under the influence of drugs or alcohol.

Any cognizable offense under the Code of Criminal Procedure, 1973, including fraud, sexual offenses, use of a motor vehicle to commit cognizable offenses, or any crime involving property damage, theft, acts of violence, or acts of terror within the past 3 years.

Outstanding Challans:

You have cleared all applicable traffic challans for the Vehicle before integrating with the BITO Platform.

You must complete the registration process on the BITO Platform by providing accurate Information as requested during registration.

Additionally, we may request further Information or documents to reasonably verify your identity, including steps to confirm your ownership of your email address or financial instruments, or verifying your Information against third-party databases or other sources. We retain the right to terminate, suspend, or restrict access to the Platform if we cannot obtain or verify this Information.

You are solely responsible for safeguarding the confidentiality of your login credentials (username, password, etc.) provided during your registration, and BITO is not responsible for any losses you may incur due to unauthorized use of Your Account, with or without your knowledge.

You agree to accept responsibility for all activities occurring through Your Account and establish reasonable security procedures and controls to limit unauthorized access to your login credentials, including choosing strong and secure passwords. Your login credentials encompass your username and password for Your Account as well as any third-party accounts used to log in to Your Account.

If you suspect that someone else knows your login credentials or if your password is being used in an unauthorized manner, you agree to inform us immediately.

BITO will not be held responsible for security breaches or unauthorized usage of Your Account.

The Company will receive customer service requests made through the Platform ("Service Requests") and transmit them to you through the Platform, or by other methods at BITO's discretion. While using the Platform, Pilots are prohibited from accepting rides through street hailing or other means.

BITO reserves the right to discontinue or introduce other modes of Service Requests and providing Services. In the case of Package Services, Pilots are not permitted to tamper with, damage, open, or interfere with parcels beyond the scope allowed during the provision of Services.

For training and improvement of customer care services, including complaint handling, the Company may monitor and record calls you make to customers, and you provide your consent for this practice.

BITO will not be held liable if you fail to download the correct mobile application, including the correct and compatible version of the BITO mobile application.

You agree that BITO, its affiliates, or third parties may communicate with you regarding the Platform or the Services, either electronically (e.g., push notifications) or through phone calls, WhatsApp, email, or written communication through other means.

III. YOUR CONDUCT

As a Pilot with BITO, you are expected to adhere to the following guidelines and conduct yourself in a professional and responsible manner:

Accepting Service Requests:

You should not reject Service Requests from customers unless it is absolutely necessary or under exceptional circumstances as deemed acceptable by BITO at its sole discretion. Consistent denial of Service Requests may result in appropriate actions, including suspension or permanent deactivation of Your Account and termination of these guidelines.

Compliance with Laws:

You must refrain from engaging in any conduct that BITO reasonably believes to be disreputable or capable of damaging BITO's reputation. Compliance with all applicable laws of the Republic of India is mandatory.

Platform Usage:

In relation to the BITO Platform, you must:

Not authorize others to use Your Account or your Vehicle.

Not assign or transfer Your Account to any other person or legal entity.

Not use the Platform for unlawful purposes, including sending or storing unlawful material or for fraudulent activities.

Not use the Platform in a way that causes nuisance, annoyance, or inconvenience to customers, BITO, or any other person.

Not consume alcohol or drugs or be under the influence of drugs or other illegal substances before or during the provision of Services. BITO has a zero-tolerance policy regarding the use of drugs, alcohol, intoxicants, or illegal substances. Customers can report such behavior to BITO, and strict action will be taken, including suspension of your Services / Your Account while under investigation and termination.

Not impair the proper operation of the network/ Platform or use any devices or software intended to damage, interfere with, or affect the functionality or operation of the Platform.

Not take any action that imposes an unreasonable or disproportionately large load on the Platform infrastructure.

Not attempt to harm the Platform in any way.

Not copy, distribute, or use any content on the Platform without written permission from BITO.

Not use the Platform with an incompatible or unauthorized device.

4. Content Restrictions:

You must not upload, display, share, host, publish, or transmit any information that:

Belongs to another person or for which you do not have the right.

Is harmful, offensive, harassing, obscene, pornographic, invasive of privacy, hateful, racially or ethnically objectionable, or otherwise unlawful.

Infringes on patents, trademarks, copyrights, or any other proprietary rights.

Harms minors or is harmful to children.

Contains commercial material or content, including solicitation of funds, advertising, or marketing.

Deceives or misleads the recipient or communicates false or misleading information.

Impersonates another person.

Contains software viruses or any other computer code designed to interrupt or limit the functionality of any computer resource.

Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order.

Violates any law currently in force.

BITO reserves the right to immediately terminate the use of the Platform by Pilots who do not comply with the above rules outlined in Clauses III.3 and III.4.

5. Operating Hours:

Pilots are not permitted to operate on the Platform for more than 12 hours on a calendar day. A mandatory break of 10 hours should be taken before subsequent login into the Platform to offer Services.

6. Verification and Training:

Pilots must consent to provide identity documents for police verification and background checks conducted by BITO, directly or indirectly through a third party appointed by the Company. Pilots are required to complete a mandatory 30-hour induction training program before onboarding with the BITO Platform and agree to undergo any other training programs as required by applicable law or as deemed necessary by BITO.

7. Medical Examination:

Pilots will not be allowed to operate without undergoing a complete medical examination, including an eye check-up through a medical institution prescribed by BITO. The cost of such a medical check-up will be covered by the Company.

8. Spot Checks:

BITO or its personnel may conduct spot checks of the Vehicles to verify and ensure your compliance with these guidelines and applicable laws.

IV. PAYMENT TERMS

BITO's payment terms are as follows:

Service Fees:

BITO retains the discretion to charge fees to Pilots, the details of which will be updated on the Platform from time to time. These fees are subject to applicable taxes.

Convenience Fee:

BITO charges a convenience fee from customers for facilitating the Services through the Platform.

Fare Collection:

Pilots are responsible for collecting the total service/travel fee ("Fare") directly from customers, either through their own QR code or in cash.

Commission:

For subscribed drivers, they receive the total amount directly from customers using their own QR code or cash. For unsubscribed drivers, BITO charges a commission based on the total fare collected by the Pilot. This commission is deducted before the remaining amount is settled with the Pilots.

These payment terms are established to ensure the smooth functioning of BITO's payment system and service fees. It is essential for Pilots to adhere to these terms and conditions.

V. Customer Ride Cancellation:

Pilots are strictly prohibited from requesting customers to cancel a ride after reaching their pick-up location. The company actively monitors driver locations based on time. If a customer cancels within the specified time frame, Pilots may face suspension.

These guidelines are implemented to uphold the safety, integrity, and professionalism of the BITO platform and its Pilots. Violations of these guidelines may result in disciplinary actions, including suspension or termination of Your Account.

VI. REPRESENTATIONS, WARRANTIES, AND COVENANTS

The Drivers and the Company represent the following:

They have all requisite power and authority to deliver and perform the obligations imposed herein.

The execution and performance of the obligations do not and will not violate any provision of any existing agreement, law, rule, regulation, any order, or judicial pronouncement which is applicable to each party.

They have not been convicted by any court in India or any other country of any crimes, including but not limited to those involving moral turpitude.

The Drivers hereby represent, warrant, and covenant the following:

They have the requisite authority or assignment to drive the Vehicle, and there are no restrictions with respect to the use of the Vehicle that will hinder the Driver from the performance of the Services or using the Platform.

They have all rights, licenses, and permits as may be required under applicable laws to perform the Service in accordance with these T&Cs.

They are in compliance with the Motor Vehicles Act, 1988 (“MV Act”), Food Safety and Standards Act 2006, and any other applicable laws (including rules, regulations, and orders notified thereunder) as required to be complied with by any person driving Vehicles and providing the Services.

At the time of onboarding with the Platform, they have not been convicted within the past 3 years for the offense of driving under the influence of alcohol or any cognizable offense under the Code of Criminal Procedure, ‘1973 or the Indian Penal Code, 1860 (as may be applicable), including fraud, sexual offenses, use of a motor vehicle to commit a cognizable offense, a crime involving property damage or theft, acts of violence, or acts of terror.

They hold and will maintain updated/renewed licenses, insurance, and permits necessary for the use of Vehicle.

They will adhere to the following passenger restrictions for different types of vehicles:

Bikes: Only 1 person is allowed.

Autos: A maximum of 3 persons is allowed.

Cars: A maximum of 4 persons is allowed, with variations based on specific car types, as per the requirements of BITO.

They will not drive rashly, will follow traffic regulations and all applicable laws, not consume liquor/cigarette/bidi, or any other kind of intoxicant, and will have and hold a valid driving license and registration/insurance papers for the Vehicle at all times, during the performance of the Services. The Driver will not take any personal calls except in the event of an emergency, without prejudicing the safety of the Vehicle and the customer. The Driver will take all calls from the customer and the Company only after stopping the Vehicle at an appropriate location to take the call, without being a hindrance to the traffic around him or without violating any traffic rules.

They will provide the Services in a courteous and professional manner as reasonably expected by a service provider providing the Services.

They will, at all times during which they are undertaking the Services, maintain dress, appearance, and hygiene codes reasonably expected from a service provider.

They will perform their obligations with promptness and use reasonable care and skill and in accordance with standards of diligence, care, skill, quality, and integrity to be reasonably expected of an experienced and reputable provider of Services.

They will provide Services in accordance with all the specifications that may be prescribed and formulated by the Company from time to time.

They will follow all the standard operating procedures (SOPs) and policies that may be prescribed and formulated by the Company from time to time.

They will not carry any weapons, firearms, ammunition, explosive devices, and dangerous substances during the performance of the Services.

They will not seek any extra monetary compensation from the customer for the completion of Services by way of tips or otherwise.

They will not commit any fraud while providing the Services or otherwise commit any act or omission, to gain any undue advantage, which may include, but not be limited to: intentionally falsify information; accept Service Requests without the intention to complete or provide the Services, provoke customers to cancel for fraudulent purposes; claim fraudulent fees or charges; intentionally request, accept, or complete fraudulent or falsified Service Requests; deliberately increase the time or distance of a trip or delivery for fraudulent purposes or otherwise; claim to complete a delivery without ever picking up the delivery item; picking up a delivery item but retaining all or a portion of the item, or not delivering the entire order; actions intended to disrupt or manipulate the normal functioning of the Company’s Platform, including manipulating the settings on a phone to prevent the proper functioning of the Platform and the GPS system; or falsify documents, records, or other data for fraudulent purposes; creating improper duplicate accounts; or falsify documents, records, or other data for fraudulent purposes, or any other fraudulent, negligent, or unlawful activity in contravention of the intent of these T&Cs, permitted scope of Services envisaged under these T&Cs, or applicable laws.

They will not allow more than the specified number of passengers on their vehicles, as per the passenger restrictions outlined above.

They will ensure that the Vehicle has a valid fitness certificate issued, insurance certificate, pollution under control certificate, and other permits/certificates/licenses and will operate under valid and subsisting permit(s) granted under relevant provisions of MV Act or any other applicable law.

They will adhere to applicable laws, including in relation to road safety, abide by traffic signals, speed limits, and such other norms or rules applicable for plying the Vehicle on the road.

They will perform each pick-up and delivery in the most efficient manner possible and will make best efforts to adhere to the timelines prescribed.

They will also ensure that the safety of passengers is not compromised during the performance of the Services.

They will report to BITO immediately if any illegal or prohibited items are being provided by customers or asked to be delivered by the customer.

Furthermore, any misbehavior or lack of professionalism towards customers may result in legal actions taken against you. By agreeing to these conditions, you accept and agree to abide by them.

VII. RELATIONSHIP BETWEEN THE PARTIES

Independent Contractor:

Drivers operating under the BITO platform will be recognized as independent contractors. The relationship between BITO and the Drivers is based on a principal-to-principal basis. BITO and the Drivers are distinct legal entities, and nothing in these T&Cs will be interpreted to establish a partnership, joint venture, association of persons, agency (disclosed or undisclosed), franchise, sales representation, or employment relationship between BITO and the Drivers. It is important to note that Drivers do not have the authority to enter into contracts on behalf of BITO or bind the company in any manner. This reinforces BITO's commitment to treating Drivers as independent contractors and maintaining a clear distinction in the working relationship.

VIII. DRIVER INFORMATION

BITO may collect Driver Information during the onboarding process and periodically to verify and establish the identity of Drivers. BITO retains the right to store, process, access, and utilize Driver Information for various business purposes, including background checks, verification, marketing, service improvement, analytics, research, and other purposes in accordance with BITO's Privacy Policy and applicable laws. Drivers provide explicit consent for the collection and utilization of their information for these purposes.

In compliance with applicable laws, BITO may share Driver Information or information related to Drivers with third parties, governmental agencies, or judicial bodies in the event of complaints, disputes, conflicts, or accidents involving a Driver, a passenger, or a third party.

We encourage Drivers to review our Privacy Policy to gain a comprehensive understanding of how we manage and handle the information collected from them.

“Driver Information” encompasses any personal data or information collected from Drivers, including know your customer documents associated with the Driver's bank, valid government-issued vehicle registration certificates, mobile numbers, bank account details, vehicle insurance documentation, driving licenses, identity proof, self-captured images (selfies), proof of residence, location data, proof of vehicle ownership, and any other information deemed necessary by BITO. This comprehensive definition ensures clarity in our data collection and utilization practices, aligning with BITO's company guidelines.

IX. CONFIDENTIALITY

Confidentiality of Data:

Drivers are required to maintain the confidentiality of all data, including passenger information, market insights, work-related documents, and all information contained within the platform. They shall not sell, distribute, or make this information available to any third parties. Unless otherwise agreed upon, passenger data will remain the exclusive property of BITO, and Drivers are not authorized to use or share this data for any purpose other than providing services, as permitted by BITO. This commitment to confidentiality is crucial to protect the privacy and security of our passengers and our business operations.

Definition of Confidential Information:

Confidential information encompasses all non-public information related to BITO or disclosed by BITO or its affiliates, which is designated as confidential or should reasonably be considered as such based on the nature of the information or the context of its disclosure. This includes, but is not limited to: (a) information about services and the platform; (b) details about BITO's technology, software, passengers, business strategies, product plans, marketing activities, financial information, and other business-related matters; (c) third-party information, including that of passengers, which is required to be kept confidential; (d) information about discussions or negotiations between Drivers and BITO or its affiliates; and (e) any other information that should reasonably be kept confidential.

These confidentiality provisions align with BITO's company guidelines and serve to protect sensitive information and maintain trust with our passengers and business partners.

X. PROPRIETARY RIGHTS

Ownership and Intellectual Property:

BITO is the exclusive owner and lawful licensee of all rights related to the platform and its digital content, including design, layout, text, images, graphics, sounds, videos, and the website or any other digital media content. These rights are protected under worldwide copyright and other applicable laws. All titles, ownership, and Intellectual Property Rights in the platform and its content (excluding third-party links) are retained by BITO, its affiliates, agents, authorized representatives, or licensors as appropriate.

Definition of Intellectual Property Rights:

"Intellectual Property Rights" encompass various proprietary rights, including patent rights, copyrights, trademarks, trade names, domain names, trade dress, trade secrets, industrial design rights, and any related registrations, applications, renewals, and extensions in any jurisdiction around the world.

All rights not explicitly granted in these T&Cs or by BITO are expressly reserved. The information provided on the platform is intended for general personal use, and users are responsible for its use.

Any unauthorized copying, modification, use, or publication of BITO's trademarks, service marks, or word marks is strictly prohibited.

License to Use the Mobile Application:

Subject to compliance with these T&Cs, BITO grants Drivers a limited, non-exclusive, non-transferable license to download and install a copy of the BITO mobile application on a single mobile device owned or controlled by the Driver. This license is solely for personal use and for the purpose of providing services.

Driver Data:

All rights, title, and interest in Driver Information, Other Information, and associated Intellectual Property Rights are owned and retained solely by the Driver. Driver grants BITO an unlimited, non-exclusive, royalty-free, worldwide license to use Driver's Information and perform necessary acts to operate, maintain, improve the platform, and provide services to passengers. This includes a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use, reproduce, modify, and distribute Other Information as part of Aggregated Statistics.

Aggregated Statistics:

BITO may monitor Driver's use of the platform and utilize data and information in an aggregate and anonymous manner to create Aggregated Statistics. All rights and Intellectual Property Rights related to Aggregated Statistics belong to BITO. Driver acknowledges that BITO compiles these statistics based on various inputs but does not identify any specific Driver.

Restrictions:

Drivers are prohibited from performing the following actions:

Licensing, sublicensing, selling, reselling, transferring, assigning, distributing, or commercially exploiting the platform in any way.

Modifying or creating derivative works based on the platform.

Creating internet links or frames on other servers or devices.

Reverse engineering, accessing, or copying the platform for unauthorized purposes, including designing competitive products, launching automated programs, or any activities that hinder platform operation.

These proprietary rights and restrictions are outlined in accordance with BITO's company guidelines to protect our intellectual property and maintain the integrity of our services.

VIII. INDEMNITY

Driver's Responsibility:

The Driver undertakes to indemnify, defend, and hold harmless BITO, its affiliates, licensees, officers, directors, agents, and employees from any claim, liability, obligation, loss, damage, deficiency, assessment, judgment, cost, or expense arising due to inaccuracies, breaches, or failures in performing obligations under these T&Cs or applicable laws concerning service provision.

Indemnification Process:

BITO has the right to assume exclusive defense and control of any matter requiring Driver's indemnification, including settlement rights, at Driver's expense. The Driver is obliged to cooperate with BITO in such matters. BITO will make reasonable efforts to notify the Driver of any claims or actions brought by third parties that require indemnification.

IX. DISCLAIMERS

General Disclaimer:

BITO does not guarantee the reliability, timeliness, quality, suitability, availability, accuracy, or completeness of the services provided by BITO and the platform. The use of services and the platform is provided "as is" without any warranties.

Specific Disclaimers:

BITO disclaims:

Security, timeliness, and uninterrupted service usage.

Meeting specific requirements or expectations.

Accuracy and reliability of stored data.

Correction of errors or defects in services or the platform.

Freedom from viruses or harmful components.

Internet-Related Limitations:

Access to the platform or services may experience limitations, delays, or problems due to various factors inherent to the internet, including server and network issues, software problems, system overloads, weather conditions, disasters, and other external factors.

X. LIMITATION OF LIABILITY

No Liability for Quality or Suitability:

BITO disclaims any liability for the quality, merchantability, fitness for specific purposes, or any other conditions regarding the platform or services provided.

No Liability for Breach:

To the extent permitted by applicable laws, BITO disclaims liability for civil, criminal, or tortious consequences arising from the Driver's:

Violation of applicable laws related to the platform or service use.

Violation of terms of licenses and permits issued by transport authorities.

Breach of these T&Cs.

Breach of duty of care towards platform users.

No Liability for Driver Actions:

BITO is not responsible for the Driver's vehicle quality. Any agreements regarding the provision of vehicles are solely between the passenger and the Driver.

No Endorsement of Information:

BITO does not endorse or represent the accuracy or reliability of any information, advertisement, or product quality displayed, linked, or obtained through the platform or services.

Limitation of Liability:

In no event will BITO be liable for any indirect, punitive, incidental, special, or consequential damages, even if it has been advised of the possibility thereof. Furthermore, BITO's aggregate liability, whether in contract, tort, warranty, or otherwise, will not exceed INR 1500/-.

These disclaimers and limitations of liability are in accordance with our company guidelines to provide transparency and set reasonable expectations for our services.

XI. TERMINATION

Termination by BITO:

BITO reserves the right to terminate these T&Cs at its sole discretion with immediate effect. Grounds for termination include, but are not limited to:

Violation or breach of any term in these T&Cs.

Misuse of the Platform.

Non-compliance with applicable laws.

Failure to verify or authenticate Driver Information.

Actions or omissions that can lead to legal or contractual liability for BITO.

Detrimental actions affecting the business interests of BITO, such as misbehavior, criminal offenses, concealment of material information, or poor performance.

Further actions including fraudulent conduct, passenger complaints, or violations of applicable laws.

Immediate termination for certain offenses like drunken behavior or spreading detrimental content.

Any negative findings during a background check during the term of these T&Cs.

BITO may terminate without prior notice.

Termination by Either Party:

Either BITO or the Driver may terminate these T&Cs by providing 7 days' written notice to the other party.

Legal Action:

BITO reserves the right to take legal action if it suspects fraudulent activity or T&C violations, with no responsibility for any consequences to the Driver.

Upon Termination:

Driver will cease Platform access and service provision.

BITO will settle outstanding dues to the Driver, subject to any deductions.

Driver must return BITO's property, including confidential information.

Driver must cease any association with BITO.

XII. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION

Governing Law:

These T&Cs are governed by and interpreted in accordance with the laws of the Republic of India.

Jurisdiction:

Parties submit to the exclusive jurisdiction of Hyderabad, India, with exceptions mentioned.

Dispute Resolution:

Disputes will be initially settled amicably. If no agreement is reached within 15 days, disputes will be resolved through arbitration as per the Arbitration and Conciliation Act, 1996, with an arbitrator mutually appointed. The arbitral tribunal's award will be final and binding.

XIII. ASSIGNMENT

The Driver cannot assign rights or obligations under these T&Cs without prior written approval from BITO. BITO can assign its rights and obligations without prior consent or notice.

XIV. AMENDMENT

These T&Cs may be amended at BITO's sole discretion. Notice of material changes will be provided, but it is the Driver's responsibility to review T&Cs periodically. Updated T&Cs will be immediately effective upon posting on the Platform.

XV. SEVERABILITY

If any provision of these T&Cs is invalid or prohibited by applicable Indian laws, it will be severed, and the remainder will remain valid and binding.

XVI. NOTICES

Notices may be provided through the Platform, electronic mail, or written communication to the Driver's address. The Driver should send notices to support@bito.org.in.

XVII. CUSTOMER CARE AND GRIEVANCE REDRESSAL

For customer care and grievances, Drivers can reach out to support@bito.org.in. Complaints, disputes, or grievances will be handled according to applicable laws.
